Place the interests of your children first!  Experienced divorce mediators can assist to ease conflict, by helping implement interim agreements during transitions, while you explore all your settlement options. Our full management approach assists you to reach settlement as an informed and empowered participant.  This helps minimize the conflict that inevitably arises out of trying to transition during the height of emotial strain.

 Mediation is a non adversarial method for reaching a settlement agreement involving all the issues that emerge from your marriage, as you head toward divorce.  The divorce mediator does not represent either party, but assists both , in a neutral capacity.  Mediators can work alongside other professionals, such as attorneys, financial advisors, CPA's and Psychologists to ensure your interests are balanced and your needs are met.  It is advisable to see if your case can be mediated at the very onset of your divorce or dispute (even pre-divorce) to minimize the conflict, limit the cost and remain in control of your family's future. 

Our California Divorce Mediators will support your family through the entire separation and divorce process. The Mediators are experienced in California divorce law.  We serve San Francisco, Marin County, Sonoma and the East Bay.  Our tele-conference and video-conference capabilties are used for out of State mediations, where California Courts have jurisdiction. 

Divorce can be overwhelming and an enormous emotional strain on the family and extended family, alike. This difficult time is exacerbated by the complexities of dividing community property, from the toaster to the Picasso, and especially awkward where there are family-owned businesses. We offer dispute resolution relating to divorce, business and personal property.

At PRIVATE COURTS™ in mediation we work to minimize conflict during your separation and divorce. We do not make decisions for you, but rather serve as neutrals who guide the process and mediate a settlement. We will assist in your preparation for mediation by providing forms and lists allowing for full and complete disclosure.  All mediation and documentation is held to the strictest standard of confidentiality and privacy.

We work with divorcing parties represented by attorneys, as well as those who are not.  In our mediation process we encourage you to seek separate counsel and legal advice from a California attorney, to fully understand your options and empower your negotiations.  Call us first so we can assist you with referrals to "mediation friendly" attorneys.  Mediation is always better served and settlement expedited when both parties possess accurate information. 

We  will provide a draft Marital Settlement Agreement and/or any necessary addendums for review by your attorneys. All agreements are non-binding until both parties have signed their acceptance. Equitable resolution will remain within your absolute control and be cost-effective. Participants are free to end the mediation process at any time.

We also serve the LGBT and Gay community with custody, support and domestic partnership mediation in California.

Custody and Child Support: This is an aspect of the divorce process that is of paramount importance. Mediation provides a forum to support Parent's through their differences as it relates to the many aspects of their children's lives. Children benefit from the resolution of conflict. They are harmed by escalating conflict.

Do not allow children to be the pawns in your divorce. They deserve their childhood and the only people to protect them are their parents. Parents should never use custody as tool to alter support obligations. Parents should always work to place the interests of their children first. At Private Courts Mediation we offer mediation services to assist in this crucial aspect of your process and where necessary are able to make excellent and time tested referrals.

 


Private Confidential Mediation, using a neutral mediator chosen by both parties.  Some mediators assist with divorce forms and documents for Court.  This is done on a session by session basis.  This method can be used with the assistance of a consulting and reviewing attorney.  The mediator usually expects you to have a good idea as to your rights and obligations, or will ensure you receive the resources to be fully empowered.  A good mediator will work to ensure a fair settlement agreement.

Mediation using “PRIVATE COURTS Full Management Method:”  This is a unique method that incorporates all divorce modalities and more: The mediator is also a full service case manager who helps both parties with every aspect of the divorce to include: referrals to and management of consultations with separate attorneys; facilitation of direct, party to party, negotiations for settling all divorce issues; full disclosure between the parties; and if necessary referrals to financial analysts, CPA’s , therapists, support groups.  As a case manager, the mediator will also provide recommended agreements,  appropriate bibliographies for parents and children. The mediator may draft or provide memorandi of understanding for  marital settlement agreements, parenting plans.   In order to keep the entire process "under one roof", divorce document assistance, divorce court filing will be offered as an option for the parties. The mediator will work to assist parties to minimizing the potential for excessive conflict. This is a resolution environment where you can customize and control your divorce and the outcome, at the same time as maintaning your dignity and minimizing the trauma for the children. This all inclusive approach is highly recommended.  The mediator should assess if this divorce approach will work for you.
