Melanie Nathan's Mediation practice focuses on the mediation of business and family issues, with particular emphasis on mediation of divorces, domestic partnerships, child custody, child support and co-parenting plans, complex community property, real estate, business and civil law disputes.
Melanie acquired a B.A. LL.B, advanced law degree in 1979, qualifying her to practice as a Barrister or Solicitor in the United Kingdom, Australia and South Africa. This degree is similar to a JD. Melanie served a rigorous two year articles of clerkship, where all facets of law are practiced under the guidance of a principal attorney.
Melanie has 30 years of legal and business experience. She has practiced law in a non-adversarial system and utilizes those techniques to provide a unique and effective settlement environment. This approach translates into extremely productive and effective sessions leading to resolution.
Melanie's method is assertive, directive and pragmatic which helps Parties reach resolution in a cost effective and timely manner. She will educate participants by providing relevant neutral information.
DIVORCE AND FAMILY MEDIATION: While checking the balance of power between the parties, Melanie will do her utmost to help adversaries steer clear of litigation, and provide guidance to deal with matters of transition to finality with compromises that are satisfactory to both Participants. She encourages empowerment through the effective use of consulting and reviewing attorneys.
Her child advocacy approach to custody & support takes into account the best interests of the children.
An experienced and well respected Mediator, Melanie has hundreds of hours of divorce mediation experience, including volunteering on the pro per panel in the Superior Court of California, Marin County.
She has pioneered a unique method to divorce and family mediation, which provides a full case management and referral source. She is a staunch believer that divorce and related decisions should be made by the parties themselves and not by the Courts. She believes attorneys should be used for consultation and review in mediation appropriate cases. She does not believe in commencing the litigation process as a first option, in most cases.
Melanie will guide clients through the divorce process, and assist with the documents, help parties choose and communicate with attorneys and other experts (if necessary) to ensure an informed distribution and fair agreement.
Note: Your settled case will be approved by the Judge, and in most cases there will be no court appearance. Melanie will assist you with an extensive choice of referrals, which she will manage at your request. She watches over your external legal costs and if you do hire attorneys Melanie's assistance will help keep your attorney fees to a minimum.
If your case requires external specialists, you do not need to do the hours of research and interviewing, as she will provide you with tested and proven choices. Melanie utilizes her effective and analytical approach when navigating complex issues.
